Frequently asked questions

Is a written employment contract required in Kenya?

Yes. Under the Employment Act 2007, an employee engaged for three months or more must have a written contract setting out the main terms of employment.

How long can probation last in Kenya?

Probation may not exceed six months. It can be extended once, with the employee's agreement, for a total of no more than twelve months.

Do we need a sexual harassment policy?

Yes, if you employ 20 or more people. The Employment Act requires employers of that size to have a written sexual harassment policy.
