Kenya Employment Law

The essentials every employer should know under the Employment Act 2007. This is a summary, not legal advice; talk to us about your situation.

  • Written contracts. Employees engaged for three months or more must have a written contract setting out key terms (Employment Act, s.9).
  • Probation. Probation may not exceed six months, extendable once by up to six more with the employee's agreement (s.42).
  • Annual leave. At least 21 working days of paid leave after every 12 consecutive months of service (s.28).
  • Maternity and paternity leave. Three months' maternity leave on full pay and two weeks' paternity leave (s.29).
  • Sick leave. After two months' service, seven days on full pay and seven days on half pay in each 12 months, with a medical certificate (s.30).
  • Fair termination. Termination needs a valid reason and a fair procedure, including a hearing for misconduct or poor performance (s.41, 43, 45).
  • Sexual harassment policy. Employers with 20 or more employees must have a sexual harassment policy (s.6).

HR FAQs

How much notice must I give to end a contract?

Where pay is monthly, at least 28 days' written notice unless the contract gives more, or payment in lieu. Summary dismissal for gross misconduct follows different rules and still needs a fair process.

Do casual workers become permanent?

A casual employee who works continuously for a month or more, or on work that can't reasonably be completed in three months, is treated as on monthly terms (s.37).

When are statutory deductions due?

PAYE, NSSF, SHIF and Housing Levy are remitted by the 9th of the following month.

Can I deduct losses from an employee's salary?

Only in limited cases allowed by section 19 of the Employment Act, and total deductions may not exceed two-thirds of wages.
